Constitutional cases: the one that got away

I’m as enthusiastic as the next conservative about the fact that a federal court has struck down Obama’s faux “recess” appointments as unconstitutional. Yet I can’t help but think of the Supreme Court case that ought to have put an end to Obamacare last year. No victory will ever be quite as important as the one that got away.
