State senators in South Carolina will host public meetings this week on proposed legislation that would nullify Obamacare. The bill argues that the Affordable Care Act has “exceeded the scope of powers granted to the federal government by the Constitution. It would establish criminal and civil penalties for anyone who attempts to enforce certain provisions of Obamacare in this state.”
Supporters of the nullification movement cite the 10th Amendment, which specifies that power not delegated to the federal government are reserved for the states. The “Freedom of Health Care Protection Act” would prohibit the state from establishing an Obamacare exchange and give a tax deduction for residents who are fined by the government for not participating.
The bill passed the SC House of Representatives in May and State Senate is set to debate the legislation in January 2014 when they return from recess.
