
Civil lawsuit filings are down 17 percent in Texas over the last 10 years. Although Texas lawyers put forth a variety of reasons for the drop, the consensus is that tort reform is responsible. The bad news, some say, is that medical malpractice cases have all but been annihilated. W. Mark Lanier of The Lanier Law Firm, says that the majority of medical malpractice cases that should be litigated have to be turned away because of the legal caps on non-economic damages.

The “Coerced Abortion Prevention Act” filed by two Texas lawmakers would make it a crime for any person to coerce a pregnant woman to have an abortion. The bill would also mandate that a physician report to law enforcement — and, where applicable, Child Protective Services — anyone who coerces a woman or pregnant minor into an abortion. It would be considered child abuse if a parent, conservator, or guardian coerced a minor to have an abortion.

The CPS worker has been charged with official oppression for subjecting a person under CPS investigation “to search and seizure that the defendant knew as unlawful.” Criminal charges against CPS employees related to their actions in child protective services cases are rare.

A District Attorney’s Office in Texas is facing multiple accusations of intentionally withholding favorable evidence from defendants, and the accusations could have major impacts on at least two cases. In the first, a former Nueces County prosecutor filed suit against the Nueces County District Attorney in mid-December claiming he was fired for refusing to withhold favorable evidence from the criminal defense. Then, late last month, defense lawyers for Hannah Overton urged visiting Judge Mario Ramirez Jr., of Edinburg, to drop the murder charge because the prosecutor in the 2007 trial intentionally withheld evidence that would have proved Overton’s innocence.

Governor Greg Abbott has appointed Stuart W. Bowen, Jr. as Inspector General for the plagued Texas Health and Human Services Commission.
