Utah Legislators Move to Protect Ability of Citizens to Open-Carry Firearms

On March 7, legislation protecting citizens who legally carry or possess “holstered” firearms “unanimously” passed out of the Utah House Law Enforcement and Criminal Justice Committee.

This legislation–House Bill 276–is expected to come up for a full house vote as early as March 10.

According to the NRA-ILA, HB 276 is sponsored by state representative Curt Oda (R-14), the goal of which is to end harassment faced by citizens who openly carry in a lawful fashion. The bill specifically protects citizens carrying or possessing “holstered or encased” firearms by preventing them from being charged with Disorderly Conduct unless there is “additional incriminating behavior.”

The Utah House is also expected to take up House Bill 373 this week. Sponsored by Ryan Wilcox (R-7), HB 373 “would require that certification by a chief law enforcement officer”–when required for the transfer of a firearm “or other item regulated by the National Firearms Act (NFA)”–be completed within 15 days, “as long as the applicant is not prohibited by law from receiving the firearm or other item.”

HB 373 is intended to prevent NFA firearm and item buyers from extended waits for purchase completions.
