Key NY lawmaker sees state legalizing daily fantasy sports

ALBANY, N.Y. (AP) — The chairman of a state legislative committee with authority over gambling predicts New York will legalize and regulate daily fantasy sports, no matter how a court fight centered on the lucrative industry turns out.

Assemblyman J. Gary Pretlow, who chairs the Committee on Racing and Wagering, says the approach state lawmakers take will depend on the outcome of the lawsuit filed by New York Attorney General Eric Schneiderman to block daily fantasy companies FanDuel and DraftKings from conducting what Schneiderman considers illegal gambling.

Pretlow led a hearing Tuesday where attorneys for both companies insisted, as they have in the court case, that daily fantasy sports is based mainly on skill, not luck. They say it therefore doesn’t qualify as gambling.

If Justice Manuel Mendez finds daily fantasy illegal, Pretlow says they’ll act to legalize it. Otherwise, he says they’ll take steps to regulate it.
