On Tuesday night, Atlanta television station Channel 2 Action News reported “that a lawsuit over the new Atlanta Braves stadium is expected to be filed against the Cobb County Commission in the next 10 days.”
Atlanta Tea Party Patriots leader Debbie Dooley told Channel 2 “[w]e believe that this is an unconstitutional use of the money, of taxpayer money.”
“This affects the entire state of Georgia,” Dooley stated, “because if Cobb County is allowed to get away with this, you can bet other counties will do everything in their power to circumvent a vote by the people for something like this.” On Tuesday, Breitbart News reported that Dooley was among several grassroots activists who believed that the $300 million the Cobb County Commission claims is the county’s share of the stadium’s $682 million significantly understates the amount of money the county’s residents will end up paying.
“We believe the legal advice they [the Cobb County Commission] received was on shaky ground,” Dooley added.
At least one attorney, part-time Fulton County State Court Judge Louis Levenson, thinks Dooley and her fellow plaintiffs might have a case. “Being around the court system for a long time, I’m astonished the decisions people make without having thought it through. I’m not saying this wasn’t well thought out, but the nuances of this could very well result in litigation for a long time,” Levenson commented.
According to Channel 2, “Dooley said they will have between five and 10 plaintiffs in the suit, involving people who live in Cobb County with several groups backing them.”
