Former Patriots tight end Aaron Hernandez, already facing three charges of murder in two separate cases, pled not guilty to an alleged assault on another inmate and asked the court to dismiss one of the murder charges today.
The former football superstar appeared in court on Monday, June 16, after being indicted on charges of the assault and battery of another inmate. He is also charged with making threats against the life of a guard while in jail. Hernandez pleaded not guilty during his appearance in court on Monday.
After being brought up on charges of murder last year, prosecutors leveled more murder charges this year against Hernandez in a wholly separate case. A Suffolk County grand jury indicted Hernandez for a double murder in May.
Along with pleading not guilty on the assault charges, Hernandez’ attorneys also filed what is being described as a “Hail May” request demanding that evidence removed from his mansion–including surveillence footage–be thrown out in the murder case of Odin Lloyd.
Defense attorneys insist that the prosecution doesn’t have enough evidence that Hernandez is culpable in the death of Lloyd and have asked that the murder charges be dismissed.
“You can’t throw a bunch of stuff at the wall. That’s not probable cause,” Hernandez’ defense attorney James Sultan said.
A date of October 6 has been set for the ex-player’s next appearance in court. The judge has yet to rule on the request to dismiss the murder charge.
