Texas Man Arrested for Alleged Premarital Sex with 16-Year-Old Wife

LUBBOCK, Texas–A Houston-area man who is reportedly legally married to a young woman has been arrested for allegedly having premarital sex with his wife. The man is 41-years-old and his wife is 16-years-old. The man, Illich Guardiola, is reportedly a drama teacher and now stands accused of sexual assault of a child.

Reuters’ Amanda Orr reported on the incident and wrote that the teacher’s issues with law enforcement began when he was pulled over by authorities in a traffic stop. Police reportedly began questioning him about the teenager in the car with him–his wife.

Guardiola reportedly had permission from the 16-year-old’s mother and married the young girl in Las Vegas.

Reuters reports the Houston-area Spring Valley Police Department as stating, “The marriage is absolutely legal. We received a copy of the marriage certificate.” However, the report indicates that police believe “circumstantial” evidence exists to indicate the couple engaged in sexual intercourse prior to marriage. Though sexual intercourse with the girl is legal in the State of Texas now that they are married, any intercourse prior to the marriage would be sexual assault of a child.
