Holder: ‘Abolish the Electoral College,’ Different Wait Times To Vote Violate Equal Protection Clause

On Friday’s broadcast of HBO’s “Real Time,” former Attorney General Eric Holder argued that the Electoral College needs to be abolished, and the different waiting times to vote in different places violates the Equal Protection Clause of the Constitution.

When asked how to solve Democratic candidates getting more popular votes, but not being elected president, Holder responded that he was working on an article that “there’s a simple solution to it. We have to just abolish the Electoral College.”

Later in the interview, host Bill Maher that disparities in how long you have to wait to vote seems like a violation of the Constitution’s Equal Protection Clause, Holder responded, “Against the Equal Protection Clause of the Constitution, and goes against the fundamental thing that binds as Americans, the ability of the people to decide who their leaders are, who their leaders are going to be, and what policies those leaders will shape.”
