On May 15th, U.S. District Court Judge Amy Berman Jackson indicated “she’s inclined to split the difference between Congress and the White House” in the lawsuit dealing with document requests about Operation Fast and Furious.
According to Politico, Jackson said that she was “poised to reject the most extreme arguments put forward by lawyers for the House and for the Obama administration.” She also “appeared to harbor some hope that hinting at her likely ruling” would encourage both sides to settle “the long-running document dispute that led to Attorney General Eric Holder being held in contempt of Congress by the House in 2012.”
The case is singular inasmuch as “there is little or no precedent for a congressional committee suing to enforce a subpoena for agency documents.”
Judge Jackson told the courtroom, “I don’t think anybody’s got a case on point. We’re all dealing with a netherworld.”
She added, “It’s always nice to be told you are deciding something no one’s ever decided before.”
