Last week a New Jersey appellate court upheld the ruling that a southern New Jersey man cannot own guns because his wife is a felon “who’s been accused of domestic violence.”
The ruling came in an appeal of “decisions made by a state Superior Court judge and the police chief in the Burlington County town where the man lives.”
According to the AP, the appeal was heard by a “two-judge panel” which “found that the guns’ presence in the man’s home would give his wife greater access to firearms, creating an unacceptable threat to public health, safety and welfare.” The panel said that the man–whose name is not being released “to protect his 13-year-old son’s privacy”–does have constitutional rights, but those rights are “subject to reasonable limitations.”
Again–the man is not a felon, his wife is.
This ruling goes directly to the danger Breitbart News, the NRA, Gun Owners of America, and others have pointed to regarding the push to couple domestic violence legislation with gun control in various states around the country. This push has been undertaken by Micheal Bloomberg-sponsored gun control groups like Everytown for Gun Safety and Moms Demand Action and has been a central component of Gabby Giffords’ gun control push since 2013.
The ruling also highlights the danger of “Gun Violence Restraining Orders,” which are now the law of the land in California.
These measures not only open the door to confiscating firearms from felons and/or domestic abusers in the home, but from all other people living in the home as well.
