The State Department has informed the Senate Judiciary Committee that it cannot locate emails belonging to Bryan Pagliano, the former IT director for Hillary Clinton who maintained her private email server during her tenure as secretary of state.

Politico reports that a letter sent by Sen. Chuck Grassley, chairman of the Judiciary Committee, indicates the State Deptartment was able to find emails belonging to Pagliano from the time after Clinton left her position at the department. However, Pagliano’s emails from her four years as Secretary of State are missing.

Pagliano has previously asserted his 5th Amendment right against self incrimination, refusing to testify about his involvement setting up and maintaining Clinton’s private email server. The emails were being sought by Sen. Grassley prior to making a decision about a possible immunity deal.

“Given that the committee is unable to obtain [Pagliano’s] testimony at this time, I am seeking copies of his official State Department emails relevant to the Committee’s inquiry before proceeding to consider whether it might be appropriate to grant him immunity and compel his testimony,” the letter revealed by Politico reads.

In addition, the letter also reveals that the FBI has seized the computer Pagliano used while at the State Department. The FBI has been investigating the security of information sent and received on the server since July after a security referral was made by the Inspector General for the Intelligence Community.

The FBI seized the private server belonging to Clinton from a data center in New Jersey in August. Since then, reports have suggested the FBI was able to recover email from the server and was working to determine if it had been hacked.

Bryan Pagliano was the IT director for Hillary Clinton’s 2008 campaign for president. When she was appointed Secretary of State in 2009 by President Obama, Pagliano also took a job at the State Department as an IT specialist. Clinton then paid Pagliano privately to maintain her server during her tenure.
