A male passenger aboard a Delta Airlines flight claimed that a woman accused by passengers of performing oral sex on him “had fallen asleep in his lap,” according to a police report.

The man told police that he “grabbed her breasts on the outside of her clothes” but did not have sex with her, USA Today reports.

Witnesses, however, claimed that they tried to hide the sex act under a single blanket while another passenger had been asleep next to them, according to the Detroit Free Press.

The passengers, a 28-year-old man and a 48-year-old woman, allegedly had intercourse on the October 29 flight from Los Angeles to Detroit.

Airport police found the woman “highly intoxicated” with “bloodshot” eyes. She reportedly “yelled and screamed” as officers tried to remove her from the plane, according to the police report.

The Detroit News reports that the woman’s blood alcohol content (BAC) was 0.11, which is above the legal limit to drive. The man had a BAC of 0.06.

Police removed passengers involved in the alleged sex act from the plane upon landing in Detroit, and the FBI issued them citations for disorderly conduct and lewd and lascivious behavior.

Both passengers were released from custody and rebooked their connecting flights. The FBI is investigating the incident, but neither passenger has been charged with a crime.
