The mother of a 17-year-old teen killed April 10 in a devastating collision between a FedEx truck and a school bus has filed a negligence suit against FedEx, according to the Associated Press.
Rosie Rivera, mother of Jennifer Bonilla of Los Angeles, filed the $100 million suit against FedEx in Los Angeles Superior Court on Tuesday, alleging that the company’s trucks have a history of catching on fire due to mechanical, driver error, or cargo loading problems. Several witnesses reported that the truck was already on fire before crashing into the school bus, according to the Associated Press. Ten people died in the crash, including five students and both drivers.
FedEx responded to the suit with the following statement:
Our heartfelt condolences remain with everyone affected by this tragic accident. We remain focused on providing support to those affected and cooperating with the authorities as they conduct their investigation. This is not the time for us to discuss potential litigation.
Other defendants named in the suit are the driver of the FedEx truck and the school bus company, Silverado Stages. According to the suit, the bus didn’t have the proper emergency exits that would have allowed students to escape after the crash. The California Highway Patrol hasn’t yet confirmed the cause of the crash, according to the AP.
