TALLAHASSEE, Fla., Jan. 9 (UPI) —
The attorney for a woman who alleges she was raped by Florida State University quarterback Jameis Winston says she plans to file a lawsuit.
Pat Carroll said she wants “heads to roll” in a lawsuit she “absolutely” plans to file against Winston, the police department and possibly the university, ABC News reported Wednesday.
Carroll claims the police department was negligent in handling the investigation of the alleged Dec. 7, 2012 incident. The case was not given to State Attorney Willie Meggs until this past December. Meggs decided not to charge Winston, saying there were gaps in the woman’s account.
Tallahassee Police Chief Tom Coe said in December his department had taken the case seriously and “conducted an investigation based on information available at that time.”
Winston’s attorney says his client claims the sex was consensual.
Carroll said Deputy Assistant State Attorney Georgia Cappleman had warned her client could be in physical danger if she returned to FSU.
Cappleman denied making the statement. She said she had no opinion on whether the accuser should return to the university and did not remember warning her to stay away from campus.
The 20-year-old Winston led the Seminoles to the BCS championship over Auburn Monday. He also is a Heisman Trophy winner.
