Rep. Farenthold: Obama Amnesty an ‘Attack on the Constitution’

Wednesday on MSNBC’s “The Rundown With José Díaz-Balart,” while discussing a federal judge issuing an injunction temporarily blocking the president’s executive order amnesty, Rep. Blake Farenthold (R-TX) said President Obama’s “policies were an attack on the Constitution.”

Farenthold  said, “Listen, the president’s policies were an attack on the constitution. Congress has authority. I think the Supreme Court will uphold this ruling. I think this will make it to the Supreme Court.”

He continued, “Congress specifically has the authority to set a uniform system of naturalization. That’s the language in the constitution. What the president has done, rather than using prosecutorial discretion, which was the basis of their argument, there was set rules, there was no discretion at all. If you met these criteria, boom, you qualify. That’s what the law is for. Prosecutorial discretion is a system you look at individual facts and circumstances. You might use prosecutorial discretion for somebody who shoplifts food for their family as opposed to somebody that goes and shoplifts a diamond watch.”
