Singer Chubby Checker, the creator of the 1960s iconic dance “The Twist,” has settled a 2013 lawsuit with technology giant Hewlett-Packard Co involving a software app which measures a man’s penis size by inputting shoe-size information – dubbed the “Chubby Checker.”
According to The Guardian, Ernest Evans, better known as Chubby Checker, sought $500 million from Hewlett-Packard for “irreparable damage and harm” caused by the “Chubby Checker” app used on Hewlett-Packard’s Palm OS platform.
The app could be used by women to help them determine the size of a man’s penis; by feeding a man’s shoe-size info into the app, purportedly, the software could calculate the size of his male member.
In August, a federal judge gave Checker the right to pursue some of his case against the Silicon Valley high-tech giant, asserting the company should have inferred “that the owner of the Chubby Checker mark would never have consented to license the mark for such a vulgar purpose.”
Although Hewlett Packard agreed to a settlement, it claims that it stopped allowing the app to appear on its platforms in 2012 and that it did not create the app. The Guardian reported that Michael Santucci, Chubby’s lawyer, affirmed that the matter was resolved “to the mutual satisfaction of all parties.”
