In New Mexico’s most populous county, Bernalillo, County Clerk Maggie Toulose Oliver had 1,000 licenses printed for gay marriages before a judge in Albuquerque ruled in a hearing on the same-sex marriage issue Monday.
State District Judge Alan Malott ruled Monday afternoon that Bernalillo will issue marriage licenses to same-sex couples. The plaintiffs in the case were a lesbian couple seeking an emergency ruling as one partner is dying of cancer.
Last week, the New Mexico Supreme Court ruled a commercial photography business owned by religious Christians violated the state’s anti-discrimination law by refusing to take pictures of a gay couple’s commitment.
Last Wednesday the Dona Ana County clerk started issuing marriage licenses to same-sex couples; the Santa Fe County clerk followed suit on Friday.
