A trial jury has heard of a woman’s disbelief when she discovered her “boyfriend” of two years was, in fact, a female. The defendant stands accused of five counts of sexual assault between February and June 2013, all of which she denies.

The complainant said she thought she was having sex with a man called Kye Fortune – a half-Filipino, half-Latino man she got to know after receiving a Facebook friend request in 2011, reports the Telegraph.

Initially communicating only online, Kye later explained he had been in a car accident after which doctors discovered a brain tumour. At this point he said he was undergoing medical treatment in hospital and was not well enough to see her.

Nevertheless the pair telephoned each other frequently, during which Kye spoke in what the complainant described as a “high-pitched” voice. In a video interview with police the complainant explained:

“He was saying how much I had helped him get through his illness. [He said] it was a sign, we should get married, we should have kids, we were going to do all sorts of things.”

At the same time the defendant, Gayle Newland of Willaston, Cheshire, met the complainant telling her she knew Kye. She became a “really good friend” and eventually they decided to meet in person at a Chester hotel.

Kye made one stipulation ahead of the meeting, the complainant told police, which was that she wear a blindfold because he was “anxious about the way he looked” and that as a result of nerve and muscle damage “could not walk properly.”

The complainant said that when she entered the hotel bedroom she found a bed strewn with rose petals and Hello Kitty bears while Kye was in the bathroom. She put on a sleeping mask and scarf for the blindfold after which a “shaking Kye” came in, explaining he had signed himself out of a private hospital in Manchester.

The complainant then says the two of them had sex in which the defendant is alleged to have used a prosthetic penis. After, Kye said he had to go back to hospital. Further hotel visits and sex sessions followed where the defendant allegedly bound her chest and wore a woolly hat to disguise her appearance.

Eventually Kye visited the defendant’s flat where the truth was discovered. The complainant explained:

“When I was having sex I grabbed for the back of his head and my hand got caught on something. It did not feel right.

“I was sat on the bed, he was standing up. Something in my mind said ‘pull it [the blindfold] off, pull it off’. I just pulled it off. Gayle was just standing there… I just couldn’t believe it, I couldn’t believe it. Straight away she held her hand down over her face and said ‘it’s not what you think’.”

Newland denies all counts of sexual assault. The trial at Chester Crown Court continues.
