Attorney: Bushmaster ‘Forum-Shopping to Avoid Answering for Their Conduct’


Attorneys who filed suit against Bushmaster firearms for the families of ten Sandy Hook Elementary School victims allege that the rifle maker is “forum shopping” by removing the case to federal court, and that Bushmaster’s ultimate goal is “to avoid answering for their conduct.”

Adam Lanza stole a Bushmaster firearm on December 14, 2012, and used it in his heinous attack on the school. Therefore, Business Wire reports, a “lawsuit against the manufacturer, distributor, and seller of the Bushmaster … rifle used in the shooting at Sandy Hook” was filed. Breitbart News previously reported that the families of the ten Sandy Hook victims worked with Democrat lobbyist Karen Hinton and attorneys from Koskoff, Koskoff & Bieder to fashion and file the suit in Connecticut.

In January, the suit was removed to federal court.

According to Business Wire, Josh Koskoff contended, “This is transparent forum shopping by Bushmaster and the other defendants to avoid answering for their conduct in state court.”

The press release suggests Bushmaster and other defendants are trying to position themselves for “[immunity] from liability under the Protection of Lawful Commerce in Arms Act (PLCAA).” That act, signed by President George W. Bush in 2005, shields gun makers from lawsuits over the unlawful use of their products.
