Intrusion Suspect Holding Baseball Bat Shot by Homeowner Holding Gun

An intrusion suspect holding a baseball bat was shot and hospitalized by a Los Lunas, New Mexico, homeowner holding a gun.

KOB4 reports that 43-year-old Stephen Benevides and 34-year-old Brittany Torres knocked on the door of home in the night. Benevides was allegedly armed with a knife while Torres was allegedly carrying a bat.

The Los Alamos Daily Post reports that the homeowner answered the knock at the door, only to have Benevides and Torres allegedly begin forcing their way into the home. The homeowner was able to grab a gun near his front door and shoot both suspects, causing them to flee. They only made it a short distance down the street before collapsing, and both were then transported to the hospital for treatment.

Benevides was released from the hospital before Torres and charged with:

  • Aggravated Burglary 30-16-4A (2nd Degree Felony);
  • Attempt to commit a felony to wit Armed Robbery 30-28-1 (3rd Degree Felony);
  • Assault with the intent to commit a violent felony to wit Armed Robbery 30-3-3 (3rd Degree Felony); and
  • Conspiracy to commit a felony 30-28-2 (3rd Degree Felony).

Torres faced “numerous state charges” as well.
