Conservatives rightfully fear a second term for President Obama, but seem barely aware of the biggest threat posed by his re-election. Yes, there’s plenty of reason to worry about what Obama will pressure Congress into or do unilaterally through executive orders. Yesterday, in a case that will determine the fate of affirmative action in higher education, the Supreme Court heard Abigail Fisher’s challenge to race-base admissions at the University of Texas at Austin. With the possible exception of the Fisher case, the most closely watched affirmative action controversy of 2012 has been the one in the high-profile Massachusetts Senate race, where Elizabeth Warren’s claim that she’s 1/32nd Cherokee has been the subject of national debate since April. 11 Oct 2012

Will DOJ Take Action on FRC Shooting?

Yesterday’s violent attack on the conservative Family Research Council by an apparent gay rights activists puts the spotlight on the Obama Justice Department. Will the Department seriously investigate the shooting – which was motivated by anger at FRC’s advocacy of traditional Christian values including opposition to gay marriage – as a hate crime and, if appropriate, prosecute it as such? Those concerned with equal justice under the law should and will be watching to see whether the Department of Justice does the right thing here. 16 Aug 2012
