An Indiana man, who pleaded guilty to sexually molesting his cancer-stricken daughter, will get no jail time, court documents reveal.
Jeremy Schwer pleaded guilty to felony child molestation for molesting his six-year-old daughter who had been diagnosed with a brain tumor in 2015.
After his guilty plea, Marion Superior Court Magistrate Steven Rubick sentenced the 41-year-old father to 12 years of probation. He required Schwer to register as a sex offender and attend court appointed therapy.
The judge did not make his decision out of hand. His sentence was in response to pleas from the child’s mother, who wanted to keep her now ex-husband out of jail so he could continue to work and continue to pay her much needed child support.
County prosecutor Courtney Curtis said she asked for at least seven years in jail but understood the judge was only catering to the victim’s mother’s wishes.
Schwer’s outrage came to light when his then-six-year-old daughter told her mother that Schwer had touched her inappropriately. The child later told prosecutors that her dad made her sit on his “cat tail” and made her touch his private parts.
But saying she “completely” disagrees with the sentence, Curtis, the head of the special victims unit in Indianapolis, notes Schwer hasn’t had a job since being fired after his initial arrest and hasn’t paid a penny in support. In his defense, Schwer says he got a job a few weeks before the court date and said he fully intends to provide for his ex-wife and daughter.
