A Dallas man shot and killed an armed assailant attempting to rob him outside a Benihana restaurant earlier this week. The robber also shot the robbery victim, who survived his wounds, during the confrontation.

Witnesses reported two people getting in their car after leaving the restaurant when a man approached them and asked for a cigarette lighter, according to NBCDFW. The man then pulled a gun after putting a mask over his face.

A gunfight began when the intended victim reached into his vehicle and pulled out his own gun. The 28-year-old robber was transported to the hospital where he later died from his injury. The intended victim, a 30-year-old male, was also transported to a different hospital and was reported to be in stable condition.

The identities of both men have not yet been released by the Dallas Police Department.

No one else reported other injuries despite the combatants firing multiple shots. Police investigators told NBCDFW they recovered several shell casings near a white Chevrolet Camaro. They did not disclose the exact number of casings found.

The case is being referred to a grand jury, but no charges are expected to be brought against the robbery victim.
