NYC Subway Rider Makes Citizen’s Arrest on Passenger Accused of Assault

A New York City subway rider made a citizen’s arrest Thursday on a passenger accused of assaulting a fellow passenger on the D train.

The New York Police Department (NYPD) told the New York Post Thursday they charged Anna Lushchinskaya, 40, with one count of felony assault after a Tuesday morning incident in which she allegedly kicked a female subway passenger and yelled profanities and racial slurs at her.

“F*ck off! F*ck off! F*ck off!” Lushchinskaya shouted to the 24-year-old victim standing next to her shortly before things seemed to get physical.

A video of the incident showed the blonde woman take off her sunglasses and take an umbrella out of her purse before allegedly kicking the victim several times.

“They’re not letting me hit her back!” shouts Lushchinskaya.

Later, Lushchinskaya, who is a white woman, continued her tirade against her victim, who is Asian. She gave the victim the middle finger and then called her a “f—king c–nk.”

Another subway rider, Juan Ayala, soon intervened, forcibly detaining the woman in the subway car and on the subway platform until officers arrived. Ayala performed what is often known as a “citizen’s arrest.”

Police said Ayala, 31, suffered minor injuries as a result of the incident.

The NYPD announced on Twitter Thursday morning confirming Lushchinskaya’s arrest, thanking those who provided information and assistance leading to her capture.
