Teacher Charged with Rape for Alleged Sex with 14-Year-Old Former Student

A Seattle elementary school teacher has been charged with child rape for allegedly having sex with a former student—beginning when he was 14 years old—while he was also living in her Renton, WA, home with her and her husband and children.

According to q13fox.com, Darcy Smith, 41, a teacher at McMicken Heights Elementary School who was named Regional Teacher of the Year in 2012, was charged Monday with three counts of third-degree child rape.

Smith’s former student reported to the King County Sheriff’s Office last May that, when he was 12 years old and in Smith’s 6th grade class, he moved into his teacher’s home. A sheriff’s detective said the student reported that he began having sex with her when he was 14 and that the sexual relationship continued until he was 18 and moved out of her home.

The alleged victim, who is now 19, said he moved in with Smith and her family after he broke his collarbone in school, and Smith took him to the hospital, and then invited him to move in with her family. The former student said his mother and Smith agreed to this arrangement because Smith spoke English and lived closer to the hospital than his mother. Additionally, the student reported his mother was concerned because his older brother was involved in gangs and would have been a negative influence on the younger boy.

According to the report, the alleged victim said Smith initiated the sexual relationship in 2008, when he was 14 years old. The detective said the student added that he knew it was wrong but wanted to do it. He said that he and Smith would have sex after her husband and children went to bed and on her days off from work.

Smith is due to be arraigned in King County Superior Court next Thursday.
