FRANKLIN, Tennessee—It doesn’t look like it will be a very Merry Christmas for the woman who owns a convenience store in Fairview, Tennessee and is the alleged victim of sexual battery at the hands of IRS agent Samuel Garza.
Garza, who was arrested in September on two felony charges of sexual battery committed against the female business owner during the course of an audit, was released from the Williamson County Jail late Friday after his bond was reduced from $300,000 to $150,000.
“Garza was released on bond tonight. Bond was $150,000,” a spokesperson for the Williamson County Sheriff’s Office told Bretibart News.
The bond, sources say, was put up by the church Garza attends in the Nashville area. The alleged victim is incredulous and fearful at the release of the man whom Williamson County District Attorney Kim Helper says committed two acts of sexual battery against her in earlySeptember.
Helper told Breitbart News that Garza was indicted when the Williamson County Grand Jury convened late last month [October], and the first hearing in the felony trial will be held in Williamson County courts on January 28.”
The alleged victim now faces a Christmas and New Year’s season that is not likely to be a very happy holiday for her and her family.
As Breitbart News reported on September 23, the details of the alleged attack revealed in court testimony are highly disturbing:
IRS agent Samuel Garza committed multiple acts of sexual battery against her while conducting an audit of her business, a woman in her fifties who owns a convenience store in Fairview, Tennessee, testified at a dramatic two hour preliminary hearing in Williamson County General Sessions Court.
The Williamson County’s District Attorney’s Office told the court it has video and audio evidence that confirms the victim’s allegations and that Garza himself signed a sworn statement admitting guilt.
At the hearing, however, Garza entered a not guilty plea.
Garza, who was originally arrested September 3 on two charges of sexual battery by an authority figure, now faces two charges of sexual battery and one charge of aggravated assault. Presiding Judge M.T. Taylor, Jr. declined to lower bond for Garza, which now stands at $300,000. Bond was originally set at $200,000.
The victim testified that Garza choked her, touched her breasts, kissed her, pressed his erect penis against her buttocks in a grinding manner, and told her to touch his penis during the conduct of an official IRS audit despite her repeated pleas for him to stop.
If she did not cooperate, he told her, he would put her in jail and close down her business.
Despite her protests that she was married, in her fifties, a mother, and a grandmother, Garza persisted.
Though the court granted the victim an order of protection against Garza in September, news of his release has upset and shaken her, according to sources.
