Dem Rep. Clyburn Says Obama Must Run Against Supreme Court

Rep. James Clyburn (D-SC) laid out the Obama re-election campaign this morning on MSNBC. Foreseeing that there is a solid shot Obamacare will be struck down by the Supreme Court, Clyburn explained that Obama would have to run against the Supreme Court itself:

In terms of the Congress, I believe that it would be off-base for us to do that, but for the president, I don’t think it is. I think the president ought to take a look at what happened in years before — we’ve seen presidents run against Congress and we’ve seen presidents run against the Supreme Court. Franklin Roosevelt did it to the Supreme Court; [Harry] Truman did it to the Congress.

Obama, of course, has already tried to do this in the past; in his 2010 State of the Union Address, he attacked the Supreme Court directly and lied while doing it, causing Justice Alito to mouth “not true” as the President spoke. That failed dramatically. The fact is that the American people know that Obamacare is unconstitutional, and would have little problem with the Supreme Court saying so. If this is Obama’s strongest election argument, he’s going to have a difficult time making it.

All of these gains are nominal, you understand, but for terrified American policy makers and investors, nominal is just fine.
