Bill Cosby’s attorneys petitioned California’s Supreme Court to dismiss a lawsuit against him, filed by a woman charging that he molested her in 1974.

Judy Huth  claims that the former actor/comedian and TV sit-com icon abused her at the Playboy Mansion when she was 15 years old.

Attorneys filled the petition for review on Tuesday after the Court of Appeals and a lower court both ruled that she was entitled to sue him. The suit alleges that Huth and her 6-year-old friend met the comedian at a San Marino park. After Cosby gave her alcohol, he escorted her to the infamous mansion, where he then molested her.

Breitbart News has reported on a number of sexual abuse allegations against Cosby that surfaced over the last year.

The Los Angeles Times reported that in December the Los Angeles County district attorney’s office refused to file charges against the former entertainer, because the incident occurred 40-years ago, way beyond the statue of limitations.

Huth’s attorney, Gloria Allred, plans to fight Cosby’s petition. “We look forward to continuing to fight for Ms. Huth’s right to have her allegations against Mr. Cosby decided at trial in the Los Angeles County Superior Court,” she said in a statement.
